Tools for Giving

Incorporated in 2008, the Community Foundation of Utah is a qualified publicly supported charity under Internal Revenue Code Section 501(c)3 and 509(a)1. Our EIN is 74-3211770.

The Community Foundation of Utah exists to build and hold a permanent and growing endowment for the community's changing needs and opportunities. Unrestricted and Field of Interest Funds enable the Foundation to put resources to work where they are needed most; Donor Advised Funds allow donors to advise the use of their funds for up to two successive advisors, at which point the funds revert to the general Utah Fund.

The Board of Directors is the governing body of the Foundation responsible for administrative policy and authorization of all grants. One of the distinguishing characteristics of a community foundation, and thus the work of its Board,  is called 'variance power'.   Variance power permits the Foundation to modify a restriction on a fund.  This may happen when the Board of the Foundation determines that the restriction is unnecessary, incapable of fulfillment, or inconsistent with the charitable needs of the community.  Inclusion of the variance power in our governing documents is a legal requirement; but most importantly to donors, it allows the Foundation to take changing times into account – for instance, to modify the purpose of a fund designated to fight a disease for which a cure if found.  This power is exercised with great care, giving full consideration to the original intent of the donor and attempting to arrive at the closest similar purpose. It provides donors  with the security that their wishes are truly paramount.

We hope these documents help answer your questions,; please feel free to use them with your clients and to call us with any concerns. Members of our Professional Advisers Committee and staff of the foundation are here to help.  Just call 801.559.3005.
